The state of Montana declined to use water rights for instream flow on the Smith and Shields rivers earlier this month. This comes following a July 7 letter from Governor Greg Gianforte directing Montana, Fish, Wildlife and Parks against making calls for the two water rights, citing limited benefits of accessing additional water in the rivers in drought mitigation. Water rights are tied to what are considered “beneficial” uses like irrigation or mining.
