Chief U.S. District Judge Brian Morris rejected a University of Montana motion this week to dismiss Sontag Bowman’s claim in a Title IX suit accusing it of sex-based discrimination. UM and the Montana University System said it lacks legal merit not based on facts. Bowman will still have to prove her claims in court. If she is not able to, the university still has the option to raise the issue on summary judgement. Title IX of the Federal Education Amendments of 1972 prohibits discrimination on the basis of sex.
