The states of Montana and Wyoming are pushing back on the federal government’s claims a lawsuit over a decision to deny a permit to the proposed Millennium Bulk Terminals is moot because the project collapsed. In their response to the solicitor general’s filing last month, the states maintain the issue is bigger than one development. They claim Washington State’s actions are discriminatory to the coal industry and are causing Montana and Wyoming harm.
