U.S. Supreme Court Upholds MT Supreme Court Ruling for Opportunity Homeowners

The U.S. Supreme Court ruled Monday homeowners in Opportunity cannot further decontaminate their own property without the permission of the Environmental Protection Agency. Residents had sued Atlantic Richfield over what they consider the inadequate cleanup of smelter pollution on their property. The decision does uphold the Montana Supreme Court’s overall jurisdiction in the matter but it is not clear how much recourse that might leave the plaintiffs.
